Terms of Service
The agreement between your restaurant and RestoMama. How we protect the data you and your guests entrust to us is the privacy policy.
Terms of service
1. The agreement
These terms govern your restaurant’s use of RestoMama — the point-of-sale, kitchen, delivery, finance, workforce and growth software provided through this platform. By registering an account or using the service, the person accepting on behalf of the business confirms they are authorised to do so and agrees to these terms.
2. The service
RestoMama runs in your browser and connects to standard restaurant hardware such as thermal printers. Which modules are available depends on your plan and the features enabled for your organisation. We add and improve features over time; where a change materially reduces a capability you rely on, we will give reasonable notice.
3. Your account
You are responsible for the staff accounts you create, the roles and permissions you assign, and keeping login credentials secure. You agree to give accurate business details during registration and to keep them current. Approval and go-live may require verifying documents you submit.
4. Acceptable use
Use RestoMama only for lawful restaurant operations. Do not attempt to breach security, interfere with other tenants, resell access, or upload content you have no right to use. Guest communications you send through the platform must comply with applicable consent and marketing rules — the platform enforces per-guest consent, but the messages and offers are yours.
5. Fees and billing
Fees are quoted per location, per month, in INR, and begin after approval and go-live. Setup, hardware, printers, payment-gateway, SMS, WhatsApp and other third-party charges are billed separately or by those providers directly. Plan pricing may change with notice.
6. Availability and support
We work to keep RestoMama available and to back up your data, but the service is provided on an “as available” basis and may occasionally be interrupted for maintenance or reasons outside our control. Support is provided through the channels listed for your plan.
7. Liability
To the extent permitted by law, RestoMama is not liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid for the service in the preceding twelve months. Nothing in these terms excludes liability that cannot be excluded by law.
8. Ending the agreement
You may stop using RestoMama and close your account at any time. On termination you can export your data for the window set out in the privacy policy before it is deleted. We may suspend access for non-payment or serious breach of these terms.
9. Changes and governing law
We may update these terms; material changes will be notified and the “last updated” date above will change. These terms are governed by the laws of India, and the courts with jurisdiction where RestoMama is registered will hear any dispute.
Your data
Your restaurant’s data, and the guest data you collect through RestoMama, belongs to you. We process it to run the service for you — nothing else.
Roles
For your business data — menus, sales, staff, finances — you are the owner and we are your service provider. For your guests’ personal data — names and phone numbers used for orders, the queue, receipts and messaging — your restaurant is the controller and RestoMama is the processor acting on your instructions.
We never sell your data
We do not sell your data, and we do not share it with any third party for their own purposes or marketing. The only parties who ever process it are the vetted service providers we need to operate RestoMama for you — for example a payment gateway, the WhatsApp, SMS and email providers that deliver your notifications, and our cloud hosting and backup infrastructure. They act only on our instructions, only to the extent needed to run the service, and under confidentiality obligations. We may also disclose data if the law requires it, and will tell you where we are permitted to.
The full policy
Everything else — exactly what each product collects, including the ChowDesk Displays TV app, our lawful basis for processing, every sub-processor by name, retention periods, international transfers, security measures and your rights under the DPDP Act, 2023 and the GDPR — is set out in the privacy policy. That page is the authoritative document; this section is a summary of it.
